Terms of service

The terms for using OpenEduCat Tools for teachers and OpenEduCat Board.

Version 0.1.1

Who runs the service

OpenEduCat Tools for teachers and OpenEduCat Board are run by OpenEduCat Inc. These terms are the agreement between you and OpenEduCat Inc. when you use them.

The service

OpenEduCat Tools for teachers gives teachers OpenEduCat Board and other classroom tools. You need a free account to use any tool; the public pages only describe them. The board keeps working offline on a device where you have signed in.

Your account

You need an account to use OpenEduCat Tools for teachers. Accounts are for adults: you must be 18 or over. Keep your sign-in to yourself; you are responsible for what is done with your account.

What you create

You own the screens, name lists and other material you create. You allow us to store, copy and show it only to run the service for you. You can delete it, or your whole account, at any time.

What we own

The software, templates, comment banks and other material we provide belong to OpenEduCat Inc., all rights reserved. You may use them in your teaching, but you may not copy, sell or reuse the software. The OpenEduCat name and logo are ours.

Plans and payment

The Free plan has no charge, and we give twelve months’ notice before we take anything away from it. Free prints and downloads carry the OpenEduCat watermark and the footer line; Teacher Plus removes both. Teacher Plus and the School plan are paid subscriptions sold by OpenEduCat Inc., with payments processed by Stripe; they are not on sale yet. All sales are final, except where the law of your country gives you the right to cancel.

Our responsibility

We work to keep the service running and your work safe, and we keep backups of your account. The service is provided as it is, without warranties beyond those the law requires. We are not liable for indirect or consequential loss, and our total liability is limited to the larger of the fees you paid us in the 12 months before the claim or US $100. The rights the law of your country gives you as a consumer are not affected.

Changes and ending

We email you before a change to these terms that matters to you takes effect. We may suspend an account that breaks the acceptable use policy. You can stop using the service at any time.

Law and disputes

These terms are governed by the law of the State of Delaware, United States, and disputes go to the state or federal courts in Delaware. If you use the service as a consumer, you keep the protection of the mandatory law of your country and may also go to the courts where you live.
