School service agreement

For schools in the United States that keep student records in My Class and need a written agreement under state student privacy laws.

Version 0.1.1

When you need one

Some US states ask a school to sign an agreement with any company that keeps student records for it. Among them are New York (Education Law section 2-d), Illinois (the Student Online Personal Protection Act) and California (Education Code section 49073.1). If you use My Class for a school in one of these states, ask us for this agreement before you add students.

What it covers

The agreement says which records My Class holds, that the school stays in control of them, that we use them only to run My Class, that we never sell them or use them for advertising, how they are protected, how they are returned or deleted, and what we do after a breach. It can carry the forms a state asks for, such as the parents’ bill of rights in New York.

Who signs

Someone who can sign for the school signs it, not each teacher. Students never hold accounts, and My Class holds names, roll numbers, groups and tags only.

How to ask

Write to legal@openeducat.org with the name of the school and its state.
